From an agency’s week ·
What a lawyer wants to know about a transfer record
The agency’s lawyer has three questions: what is in there, who can see it, and can I rely on the version I read.
A draft, for the owner’s approval. Each note is published once they have read it.
At some point the agency’s lawyer hears that the deals now live in a piece of software. Their first reaction is the right one: what exactly is in there, who can see it, and is the version I reviewed the version that was signed?
What is in there
A signed deal in Eskuadra is a record with its clauses as records of their own: the kind of clause, the amount or the percentage, what triggers it, the window it applies in, who pays and the payment terms. Instalments, signing fees, bonuses, loan options and sell-ons each have a date and a state. The signed contract, any side letter and any amendment are filed on the deal, each with a version. Every change to any of it is in the history: what changed, who did it, when.
Can I rely on it
Each signed deal has a term sheet that prints clean, with a sealed copy of the record as it was when the deal was marked signed. The version the lawyer reviewed is the version that was signed, and it can be shown to be.
While a deal is drafted, Eskuadra checks it against football’s rules: representation terms, who pays, players under 18, registration windows, contract length. The checks are a compliance aid. Every rule in them is a draft until a specialist has reviewed it, and the lawyer’s review stays the lawyer’s. We say that on every report.
Who can see it
Each agency’s data is kept apart from every other agency’s by policy in the database, in the European Union. Inside the agency, roles decide who sees players, private details, pitches and money; the figures on deals and clauses are visible only to the roles the agency chooses. The lawyer can have a seat of their own on the Agency plan, with a role that sees only what they need.
What they can ask for
A full export of the agency’s data, which an admin can request. The term sheet and the clauses of any deal, printed or as a file. A data processing agreement with us, on request. We also answer security questionnaires.
What this note leaves for another day
This note follows the page we wrote for lawyers. Who the data controller is for the agency’s records, and the agreements around it, are set out in the privacy policy and the terms.
